Release of Liability: The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist, and I, KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown. I assume full responsibility for my participation, and I willingly agree to comply with the stated and customary terms and conditions for participation. If however I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the Forge 26 staff/ownership immediately. I and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release, indemnify, and hold harmless Forge 26, its owners, sponsors, advertisers, affiliates, agents, and employees, from any claims, demands, losses, or damages on account of injury, disability, death, or loss or damage to person or property, whether arising from negligence of the releases or otherwise, to the fullest extent permitted by law. I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

Member’s Agreement: Member agrees to abide by all the membership regulations of the club. Member acknowledges that the staff are available to provide instruction as to the proper use of equipment and not as fitness or medical practitioners. Member agrees that Forge 26 is a 24/7 access facility and staff will not be staffed late evening and early morning hours, as well as potentially other times. In the event of an emergency call situation, member is asked to call 911 for assistance. Forge 26 provides each member with a secure access card to enter the location. In addition, please be mindful of individuals who may attempt to use the facility without membership. Such incident will be investigated with possible forfeiture of your membership.

In regards to billing or late payments, Member agrees to pay a $10 late fee on accounts not paid in full within five (5) days past the due date. Should Member default, Member agrees to pay all costs of collection, including agency fees, court costs, and reasonable attorney fees. If for unforeseen circumstances such as the facility being unavailable due to events such as fire, flood, or other, Forge 26 will freeze memberships and reactivate once the facility reopens. Facility Closure Cancellation: In the event Forge 26 closes, seller will refund to Member a prorate share of membership cost, based upon the unused membership time remaining on the contract.
